Yogurtini serves up third Kansas City-area store in Lee’s Summit
It’s a tenant changeout this week at Summit Fair shopping center in Lee’s Summit.
Last week, B:2 A Burger Boutique announced that it was closing its restaurant less than a year after opening due to flagging sales.
Now, soft-serve frozen yogurt franchise Yogurtini announced that it is opening in the power center.
The Lee’s Summit location will be Yogurtini’s third in the Kansas City metro area, following locations that opened in 2010 at Zona Rosa and the Plaza Colonnade shops at 48th and Main streets, both in Kansas City. The store offers make-your-own nonfat frozen yogurt concoctions.
Customers pay by the ounce, choosing from 16 flavors and more than 70 toppings.
Ernesto Peralta, owner of the now-shuttered B:2, said that the restaurant had a successful lunch business but that traffic dropped precipitously after 7 p.m.
“Nine out of 10 people who came in loved it and came back. But we just weren’t getting the traffic we needed. We’re self-financed, so we don’t have the big pockets to help us for another year until things turned around,” said Peralta, majority owner of Circle Restaurant Group, which also operates Blanc Burgers + Bottles on the Country Club Plaza and in Mission Farms in Leawood.
Peralta speculated that the younger demographics in Lee’s Summit kept families with children home in the evenings. Yogurtini owners are hoping to capitalize on the family-friendly environment.
“The Yogurtini franchise is a fun, exciting and rewarding opportunity for me and my entire family,” David Kinworthy, owner of the new Lee’s Summit
store franchise, said in a written statement.
To celebrate, Kinworthy is treating new customers during Saturday’s grand opening.
“Lee’s Summit is where I know our customers would love the Yogurtini product and experience, and we are excited to be able to open and celebrate with free frozen yogurt and toppings during our grand opening event,” Kinworthy said.
The new Yogurtini store will neighbor Macy’s at 880-J N.W. Blue Parkway. The franchise is based in Tempe, Ariz.

Health care reform: Rules, lawsuits and Kansas/Missouri benefits
The Department of Health and Human Services on Tuesday released proposed guidance regarding states’ review of premium increases.
Starting next year, any proposed premium increase of 10 percent or more has to be publicly disclosed and reviewed by state departments of insurance to determine whether the increase is reasonable. After 2011, states will develop their thresholds.
Mind you, these powers concern the review of increases, not the authority to force insurers to adjust the rates. That isn’t a marked change for Kansas, which already has the authority to review rate increases. But Missouri, which doesn’t require insurers to submit proposed increases annually or have the authority to review them, might have to rely on HHS to conduct the reviews. HHS released $1 million to each state and the District of Columbia earlier this year to help with the new oversight requirements. There’s $199 million left for distribution.
“The proposed rate review policy will empower consumers, promote competition, encourage insurers to do more to control health care costs and discourage insurers from charging premiums which are unjustified,” Jay Angoff, director of HHS’ Office of Consumer Information and Insurance Oversight, said in the release.
Justifications for unreasonable increases will land on HealthCare.gov, and starting in 2014, states can exclude health plans from exchanges if they show a pattern of excessive or unjustified increases. However, that and potential loss of customers are the only consequences insurers face if they disagree with a state’s assessment.

Chalak Mitra Group LLC has bought 33 KFC, Taco Bell and Long John Silver’s restaurants in Kansas, Missouri, Illinois and Oklahoma.
The group, an affiliate of Dallas-based The Chalak Group Inc., did not disclose the purchase price for the Yum! Brands Inc. (NYSE: YUM) restaurants.
The cash purchase from Missouri company Table Rock Restaurants includes 22 restaurants in Missouri, four in Kansas, three in Oklahoma and one in Illinois. One KFC/Taco Bell restaurant is in Gardner.
Manish Patel and Pushpak Patel, current Yum! franchisees and part of The Chalak Group, will run the restaurants.
“It’s a competitive advantage for us to have Manish and Pushpak operate this division,” Chalak Group CEO Al Bhakta said in a release. “Being existing operators in the Yum! system, they bring specific skills and experiences to the business. Our goals are the same as an entrepreneur — to create enterprise value by growing and developing the business.”
The Chalak Group has multi-unit franchise experience as owner, operator and franchiser of the 56-unit fast-casual chain Genghis Grill-The Mongolian Stir Fry, which has a location in the Kansas City Power & Light District. The group had partnered with the Patels to open their first KFC and Taco Bell location in Anna, Texas.
The Patels will focus on growth within the Yum! system; Bhatka’s team will work on turning Genghis Grill into a national brand.
Both want to grow in the restaurant industry; the deal represented a vehicle to expand with Yum! Brands, said Ron Parikh, a principal of The Chalak Group.
“This is kind of a big opportunity for us,” he said, adding that the company would be open to more. “We’re open to any part of the country, as long as we have good operators.”
