


As a trial lawyer for nearly 40 years, Mike Fitzgerald has a perspective on litigation that is not shared by many attorneys. Over the years he has represented both plaintiffs and defendants in many areas of the law, including labor and employment cases, business litigation and injury cases. In the employment law area he has considerable experience representing employers and claimants in the State and Federal courts in Missouri and Kansas, as well as before the Equal Opportunity Employment Commission (EEOC), the Occupational Safety & Health Administration (OSHA), National Labor Relations Board (NLRB), the Division of Workers’ Compensation in both Missouri and Kansas, and numerous other administrative agencies.
The administrative proceedings and court cases include claims of employment discrimination and retaliation based on sex, age, national origin and race. He also advises employers regarding numerous employment issues including non-competition agreements, Workers’ Compensation, drug testing, hiring and termination, wage and hour and other employment regulations. Mike has also developed a particular expertise in the area of claims for health and disability benefits under ERISA, the virtually all-encompassing Federal law controlling employee benefits.
In the business and commercial litigation areas, Mike has represented clients regarding many issues including shareholder disputes, insurance coverage, commercial leases, unfair competition and general tort litigation.
Mike is a graduate of the University of Missouri – Kansas City School of Law where he was Student Bar Association President and member of the Law Review. He has served as President of both the UMKC All University and Law School Alumni Associations. Mike has been special counsel for the North Kansas City Police & Fire Personnel Board and is an arbitrator for the National Association of Securities Dealers (NASD). Mike is a member of the American Bar Association, Missouri Bar Association, Kansas Bar Association and the Kansas City Metropolitan Bar Association.
